Roman Catholic Diocese Of San Diego Files For Bankruptcy
San Diego, CA (AHN) - The Roman Catholic Diocese of San Diego, which was scheduled to go to trial for alleged sex abuse by a priest on Wednesday, filed for Chapter 11 bankruptcy five minutes before midnight Tuesday. Wednesday’s trial was to be the first of more than 150 San Diego lawsuits alleging sexual abuse by the church.
By filing for bankruptcy, the diocese was able halt proceedings. San Diego Bishop Robert H. Brom said in a statement posted on the diocese’s website that filing for bankruptcy was “the best way available for us to compensate all of the victims as fairly and equitably as our resources will allow.”
“We put money on the table that would have stretched our financial capability to the limit, but demands were made which exceeded the financial resources of both the diocese and our insurance carrier,” the statement said.
“We have decided against litigating our cases because of the length of time the process could take and, more importantly, because early trial judgments in favor of some victims could so deplete diocesan and insurance resources that there would be nothing left for other victims.”
The lawsuits were filed in 2003 when the legal statute of limitations was temporarily lifted by the state Legislature. The trial that had been planned for Tuesday involved a woman who said a priest forced her to have sex with him in 1972, when she was in her teens. Other suits included allegations that the diocese moved abusive priests from parish to parish to protect them.
According to AP, John Manly, a lawyer involved in a suit that was scheduled for trial in April, said, “For three years they’ve told people they want to settle, they want to be transparent, “but the moment it became clear the truth will come out through a jury trial, they sought to shut down victims’ ability to get compensated and get out the truth.”
Bishop Brom said in his statement that the church will be releasing the names of all the priests who have been accused of abuse, along with the extent of the abuse. He also said the diocese will verify that “no known abuser is functioning in the ministry.”
